Terms and Conditions

Please ensure you read and understand the following terms and conditions pertinent to your accommodation rental.  If you have any queries please do not hesitate to contact us {hereafter called the owner} for clarification before you sign the booking form.

 

Whilst we reserve the right to increase or decrease accommodation prices at any time, we will confirm to you the current price at the time of booking.  As soon as you have confirmed your booking and paid your deposit or full payment, the cost of the rental is guaranteed against further increases.  This booking is offered subject to our terms and conditions and payment being adhered to and providing you do not make further amendments to your vacation/holiday arrangements.

 

Your vacation/holiday home rental includes accommodation as booked, including services e.g electric & water, {excludes pool heating unless otherwise stated}

 

Not included in our rental prices a) flights b) vacation/holiday insurance c) car hire d) pool heating

 

1) Bookings are valid after

              I.      The booking form has been complete and signed by the owner or

           II.      The on-line booking form has been complete and the box agree to our terms and conditions  and

         III.      The appropriate deposit has been paid and

          IV.      The booking form has been confirmed in writing by the owner to the guest.

 

2) The person who signs the booking form certifies that he/she is authorized to agree the booking terms and conditions on behalf of all persons included on the booking form, including those substituted or added at a later date.  The signatory must be a member of the party occupying the property and must be 21 years or over.  Bookings cannot be accepted from parties of young people less than 21 years of age.

 

3) A 20% deposit of the total cost must accompany bookings, which is non refundable.  Upon clearance of payment the booking is confirmed.

 

The balance must be paid 70 days prior to commencement of the vacation/holiday along with a Security Bond of $400/£200

 

The Security Bond will be returned to the guest no later than 7-10 days after the completion of the vacation/holiday as long as any Key(s) are returned and no damage or loss is reported by the owner’s management company.  If damages are reported that excess $400/£200 we reserve the right to claim this off the guest.

 

Note monies returned to guests will be in the same currency which was received.

 

We reserve the right to treat the booking as cancelled if we do not receive the balance by the due date.  Any cancellation charges detailed elsewhere in the document will then apply.

 

In the event of a cheque not been honored by the bank on which drawn we will make a charge of $30/£15 to cover bank charges and our administration costs.

 

4) If a guest wished to cancel the booking he should advise the owner immediately by telephone followed by confirmation letter.  The owner shall be entitled to retain all payments already made (except the security bond deposit) and to recover, if not already paid the balance of the rental charge as follows

             I.      30-70 Days notice 50% of the rental charge

           II.      Less than 30 days Notice 100% of the rental Charge

  

5) In the unlikely event that circumstances beyond the owners control necessitate the cancellation of the rental arrangement, the owner reserve the right to cancel any bookings at any time and will only be liable to the refund monies already paid by the guest.  Furthermore, the owner cannot guarantee that all facilities described in their brochure or website will be available.

 

6) The guest agrees to pay the full cost of any breakages, losses or damage to the property, (the owner management company will be sole arbitrators on the cause of damage)

              I.      Take good care of the property and leave it in a clean and tidy condition at the end of the vacation/holiday.

           II.      To report any damages or loss immediately it is discovered to the owner’s management company in Florida.

         III.      To permit the owner or their agents reasonable access to the property to carry out any maintenance if necessary.

          IV.      Not to sublet or share the property except with persons nominated on the booking form.

 

7) No liability is accepted by the owner for loss of main services or failure of appliances, not for the consequences of the action or omissions’ of the person who may control supply of main services.  Nor any actions taken in the vicinity of the property by any authority over which is no control by the owner.  Furthermore, it is possible that some construction work may take place in the area of new homes.  The guest should establish the status of the development prior to booking.

 

8) The property is available after 4pm on the day of arrival and must be vacated by 10 am on the day of departure.  Failure to comply with this may result in an extra day’s rental charges which the guest agrees to pay.

 

9) The owner does not accept any liability for injury, damage or loss caused by any reason or claim made as a result of this booking and/or subsequent Vacation/Holiday.  The guest is responsible for taking out an adequate insurance polices(ies) to cover all risks.  This waiver is also applicable to people visiting the property as guests of the guest(s).

 

10) The owner does not accept any liability for injury, damage caused, or any such claim by a third party as a consequence of actions by the guest(s) and other people occupying the property during the period at the let.

 

11) An additional fee of $28/£13.60 per day will be levied if the guest requires pool/spa to be heated during their stay.

 

Guests may use the swimming pool at their own risk.  They should always observe the safety rules listed in the information and safety book held in the home and observe the pool safety notice in the pool area.  An adult must accompany all children at all times.  We will not be held responsible for any accidents.  Pool heating will be switched on during the day ordered and may take some time to heat the pool to optimum temperature.  Having ordered pool heating, the owner is not responsible for the weather and if it’s warmer than expected, pool heating still has to be paid for.  The solar blanket must be used when the pool is not in use (especially at night) or the heater will not function correctly.

 

Like you, we have no control over the weather! We are unable to guarantee the water temperature with pool heating as it will depend on the prevailing conditions.

 

The heater is a mechanical device, as with mechanical devices it can be subject to electrical / mechanical failure.  If such an occurrence was to happen, every effort will be made to repair the heater.  If guest has paid for pool heating, then we shall refund only the days you were without pool heat.  We cannot and will not refund for anything that has not been paid for.

 

12) The pool is cleaned and chemically balanced every week for your safety and comfort: however on rare occasions it may be necessary to apply extra chemicals to the pool to maintain a safe and correct chemical level. Should this occur during your stay it will be necessary for you to be out of the pool for a period of 12 – 24 hours for your safety reasons.

 

13) Lock outs: To avoid lock outs make sure that every members of the family exit the house through the front door.  DO NOT EXIT THROUGH THE GARAGE. Please be aware that there is a $80 charge for a locksmith call out.  This fee also applies for any lost keys.  Replace it in the key box each time you exit the villa to prevent any keys being lost.

 

14) Garbage Collection. Refer to the garbage days available in the guest welcome book.  Make sure to place the garbage at the bottom of the driveway the evening prior to pick up day.

 

15) As owners of the property, we, our servants or agents, will not be held liable for any loss or delay occasioned by any of the following: strikes, riots, political unrest, war or threat or war, terrorist activities, industrial disputes, fires, flood technical/weather problems to transport, aircraft, closure of airports or any other event beyond the owners control.

 

Aircraft captains are legally entitled to deny boarding to any passenger who presents themselves at the aircraft in an unacceptable state due to influence of drink or drugs.  Any passenger so doing will be deemed as given notice of his/her cancellation of the booking at that time and the aforementioned cancellation charge will apply.

 

16) The maximum occupancy is 10 persons for the property and is determined by the authorities within strict guidelines for fire safety.  Please note that contravention of the above will render your booking void, all monies paid will be forfeited and you will be asked to leave the property immediately without compensation.

 

17)

                        I.      We have a strict NO SMOKING policy inside the house.  Guests are welcome to smoke on the pool deck, providing that ashtrays are used and stubs/butts are carefully disposed of.  If the management company finds any evidence of smoking inside the home during your stay, this will be regarded as serious breach of contract and you will be evicted immediately.  All monies will be forfeited and you will be liable to a deep clean – this will include but not limited to, professional cleaning of all soft furnishings, linens, carpets etc. as well as a clean air fee to replace all air conditioning filters and de-odorising costs.

                     II.      We have a strict NO PETS policy.  If the management company find evidence of pets during your stay, this will be regarded as serious breach of contract and you will be evicted immediately.  All monies will be forfeited and you will be liable to a deep clean – pests control charges, this will include but not limited to, professional cleaning of all soft furnishings, linens, carpets and de-odorising costs.

 

18) Our property is situated in a quiet residential area consisting approximately 50/50 rental homes/US families.  It is a condition of the rental that you should be considerate in your behavior and keep noise levels to a reasonable level so as not to disturb our neighbours.

 

19)  Complaints: We sincerely hope you do not have any! But in the unlikely event that you wish to register a complaint during your Vacation/ Holiday, contact the Property Management Company immediately and follow this up with a letter.  Give a copy to them and send a copy on your return. Unfortunately we are not always able to control the components of your accommodation and it is possible that an advertised facility may be withdrawn or changed due to circumstances beyond our control and for which we cannot accept liability.

 

20) British citizens traveling on the visa waiver scheme and staying for less then 90 days should hold a full British passport which is valid for at least 6 months following their entry to the US.  All other nationalities should contact the US Embassy for further information.

 

21)  The property is equipped with internet access for your use.  Whilst we endeavor to have this available for our guests, routine maintenance may mean that we have to withdraw it from use at short notice.  We accept no responsibility whatsoever for this.

 

22)  For your convenience there is a security safe installed in the villa. As owners we take no responsibility for items, documents, valuables or monies that are left in the safe or loose in the villa. All items are left in the villa at the owner’s risk.  You are to ensure that you carry sufficient travel insurance for total peace of mind. If you fail to return the safe key, loose it or cause damage to the safe you will be charged $140/£70 for a replacement safe.

 

 

We strongly recommend that all guests take out travel insurance for your whole party, which includes cancellation charges cover. UK guests are also advised to take out a policy which includes medical cover as soon as you have booked any part of your vacation or holiday.  If you choose not to do this, you need to be aware that you will personally be responsible for payment of any cancellation charges which may become due.

 

I agree to pay the balance 10 weeks (70 days) prior to arrival.  I accept the terms and conditions of myself and my party.  I am over 21 years of age.
